Prof. Kaufman comments on assault charge for woman who overdosed while pregnant

The Pittsburgh Post-Gazette interviewed Prof. Rona Kaufman about the case of a Butler County woman set to stand trial on a charge that she assaulted her unborn baby when she overdosed on heroin. 

According to Kaufman, as of last year, such a charge had never been brought against a pregnant woman in Pennsylvania. 

“I think that Pennsylvania’s code is pretty protective of the woman,” said Kaufman, an expert on the intersection of the law and motherhood. “It doesn’t seem that the prosecutor should be able to move forward with this case.”
